Notice Of Trustee’s Sale At Public Auction

WHEREAS, by Deed of Trust dated the 18th day of September, 2018, John Gilstrap did convey ion trust to J. Steve Daniels, Trustee, a certain tract of land to secure payment of a debt payable to Buddy Ledbetter and wife, Sheliah Ledbetter, recorded in Record Book 196, Page(s) 1000-1002, in the Register of Deeds Office, Overton County, Tennessee, (the “Deed of Trust”) which is incorporated herein by reference;

WHEREAS, Buddy Ledbetter and wife, Sheliah Ledbetter, are the owner(s) and holder(s) of the note and beneficiaries of the Deed of Trust; and

WHEREAS, Default has been made in the payment of debts and obligations secured by said Deed of Trust and Buddy Ledbetter and wife, Sheliah Ledbetter, have declared the entire balance due and payable and has instructed the undersigned Trustee to Foreclose on said Deed of Trust in accordance with its terms and provisions;

NOW THEREFORE, by the authority vested in me as Trustee, I will on the 27th day of April, 2021 at 3 p.m., Central Standard Time, at the East door of the Overton County Courthouse in Livingston, Tennessee, offer for sale and sell at public auction to the highest and best bidder for cash in bar of all rights and equities of redemption, statutory and otherwise, homestead, dower and all other rights or exemptions of every kind, all of which are expressly waived on said Deed of Trust the property therein conveyed which is situated in the State of Tennessee, Overton County, and is described in Record Book 196, Page(s) 998-999, in the Overton County Register of Deed’s Office, and being more particularly described as follows:

BEING Lot No. 13 of the Meadowbrook Subdivision as recorded in Plat Book 1, Page 35, Register’s Office of Overton County, Tennessee, and being a portion of the premises described of record in Deed Book 142, Page 38, Register’s Office, Overton County, Tennessee.

This conveyance is subject to the restrictions as set out in the deed of previous and last conveyance, to which reference is here had.

The previous and last conveyance being a Deed of Trust in favor of Buddy Ledbetter and wife, Sheliah Ledbetter, from John Gilstrap, dated the 18th day of September, 2018, recorded in Record Book 196, Page(s) 1000-1002, Register’s Office, Overton County, Tennessee.

Current Owner(s) of Property: The Estate of John Sidney Gilstrap, Deceased, Jinny Hacker, Executrix.

Also known as: 775 Bethlehem Road, Livingston, TN 38570

The equity of redemption, the statutory right of redemption, homestead, and all other exemptions of every kind are waived in said Deed of Trust, and the title is believed to be good, but the undersigned will sell and convey only such titles as he may convey as Trustee, there being no representations or covenants of warranty of title made hereby.

This sale is subject to all matters shown on any applicable recorded plat; any unpaid taxes; any restrictive covenants, easements or setback lines that may be applicable; any statutory rights of redemption or any governmental agency, State of Federal; any prior liens or encumbrances as well as any priority created by a fixture filing; and to any matter that any accurate survey of the premises might disclose.

In addition, there are no know, Individually, Corporations, Limited Liability Companies, U.S. or State or Businesses that have government, interest or prior right to the lien/Deed of Trust as aforementioned recorded in the Register’s Office, Overton County, Tennessee.

All interested parties who are interest in purchasing should have a title opinion completed if said purchasers so desire.

However, if there are same on record, said Real Property is being sold subject thereto.

Pursuant to TCA 35-5-101(e), a copy of the above Notice, as required in TCA 35-5-104, was served upon the above referenced debtor and Interested Parties, by lodging same with the U.S. Mail, Certified Mail, Return Receipt Requested, postage prepaid, for delivery to the addresses indicated on or before February 23rd, 2021, more than thirty (30) days prior to the first publication date, pursuant to the statutory requirements.

Dates of Publication, TCA 35-5-101(a)(b); the Livingston Enterprise, a newspaper published in Overton County, Tennessee, the county where the land is located and the sale is to be made, which shall be published in the newspaper on the following dates: April 6th 2021, April 13th, 2021 and April 20th, 2021.

Said sale shall be made for cash in bar of all right and equity of redemption, homestead, dower, and all other rights of exemptions of every kind, all of which are expressly waived in said Deed of Trust.

Trust is not aware of any lein claimed by the United States with respect to which the provisions of U.S.C §7425(b) require notice to be given to the United States. Trustee is not aware of any lein or claim of lein by the State of Tennessee with respect to which provisions of §67-1-1433(b) of the Tennessee Code Annotated require notice to be given to the State of Tennessee.

This sale shall further be subject to any announcements made at the time of the sale.

The Trustee reserves the right to postpone or set over the date of sale in the event the Trustee deems it best for any reason at the time of sale to postpone or continue this sale from time to time, with such notice of postponement as deemed reasonable by Trustee. In the event the highest bidder at such sale fails to complete his purchase of subject Real Property within the applicable time allowed, the undersigned Trustee reserves the right to complete the sale of the subject Real Property, without further notice of advertisement, to the next highest bidder who is able to consummate his purchase of the property within the time permitted by the Trustee. The proceeds derived from the sale of the property will be applied as provided for in said Deed of Trust and are made a part hereof as if set forth verbatim herein.

At the conclusion of the sale, I, J. Steve Daniels, Trustee, will make, execute, and deliver a Trustee’s Deed to the purchaser at the sale of the herein described land, as Trustee, in as full and ample manner as the Trustee can convey the same.

Notice is hereby given that on the 15th day of April, 2021, Letters of Testamentary, in respect to the estate Earl Watkins, deceased, who died March 25, 2021 were issued to the undersigned Randel Watkins by the Chancery Court/Probate Division of Overton County, Tennessee.

All persons, resident and non-resident, having claims, matured or not, against the estate are required to file same with the Clerk and Master of the above named Court on or before the earlier dates prescribed in (1) or (2) otherwise their claims will be forever barred:
