The Overton County Board of Education has been named in a federal suit, alleging they are in violation of Civil Rights.
A Livingston Academy student along with her parent, Richard Penkoski, filed suit in the United States District Court for the Middle Tennessee District on Friday, Oct. 16.
The complaint alleges the district is in violation of:
The Freedom of Speech clause of the First Amendment to the U.S. Constitution; the Free Exercise clause of the First Amendment to the U.S. Constitution; the Due Process clause of the Fifth and Fourteenth Amendments to the U.S. Constitution; the Equal Protection Clause of the U.S. Constitution and the Religious Freedom Restoration Act of Tennessee.
