The State of Tennessee, Department of Children’s Services, has filed a Petition to Declare Child Dependent and Neglected as to Diane Chilton and her minor child, K. Chilton. It appears that ordinary process of law cannot be served upon you because your whereabouts are unknown. You are hereby ORDERED to serve upon Jessica Krebs, Attorney for the Tennessee Department of Children Services, 600 Hearthwood Court, Cookeville, Tennessee 38506, (931) 372-7127, an Answer to the Petition to Declare Child Dependent and Neglected filed by the Tennessee Department of Children Services, within thirty (30) days of the last day of publication of this notice, and pursuant to Rule 39(e)(1) of the Tenn. R. Juv. P. you must also appear in the Juvenile Court of Overton County, Tennessee at Livingston, Tennessee on the 20th day of May, 2020, at 9:00 a.m., for the Hearing on the Petition to Declare Child Dependent and Neglected by the State of Tennessee, Department of Children’s Services If you fail to do so, a default judgment will be taken against you pursuant to Tenn. Code Ann. § 36-1-117(n) and Rule 55 of the Tenn. R. of Civ. P. for the relief demanded in the Petition. Notice Of Trustee’s Sale At Public Auction

WHEREAS, by Deed of Trust dated the 3rd day of March, 2014, Robert Porter did convey in Trust to J. Steve Daniels, Trustee, a certain tract of land to secure payment of a debt payable to Jerry Bilbrey and Joyce Bilbrey, recorded in Record Book 132, Page(s) 59-61, in the Register of Deeds Office, Overton County, Tennessee, (the “Deed of Trust”) which is incorporated herein by reference;

WHEREAS, Jerry Bilbrey and Joyce Bilbrey are the owner(s) and holder(s) of the Note and beneficiaries of the Deed of Trust; and

WHEREAS, Default has been made in the payment of debts and obligations secured by said Deed of Trust and Jerry Bilbrey and Joyce Bilbrey have declared the entire balance due and payable and has instructed the undersigned Trustee to Foreclosure on said Deed of Trust in accordance with its terms and provisions;

NOW THEREFORE, by the authority vested in me as Trustee, I will be on the 28th day of April, 2020, at 10:00 a.m., Central Standard Time at the East door of Overton County Courthouse in Livingston, Tennessee, offer for sale and sell at public auction to the highest and best bidder for cash in bar of all rights and equities of redemption, statutory and otherwise, homestead, dower and all other rights or exemptions of every kind, all of which are expressly waived in said Deed of Trust the property therein conveyed which is situated in the State of Tennessee, Overton County, and is described in Record Book 132, Page(s) 59-61, in the Overton County Register of Deed’s Office, and being more particularly described as follows:

Lying and being in the 6th Civil District of Overton County, Tennessee, to wit:

BEGINNING at a set corner of the O’Neal Road, and running thence Westwardly 380 feet with the line of Lloyd Williams to a set stone; thence Northwardly 82 feet to a set in the line of James Paul Masters et ux Thelma Masters’ thence Eastwardly 380 feet with the line of James Paul Masters et ux, to a set stone I the O’Neal Road; thence southwardly 82 feet to the Beginning corner.

The equity of redemption, the statutory right of redemption, homestead, and all other exemptions of every kind are waived in said Deed of Trust, and the title is believed to be good, but the undersigned will sell and convey only such titles as he may convey as Trustee, there being no representations or covenants of warranty of title made hereby.

This sale is subject to all matters shown on any applicable recorded plat; any unpaid taxes; any restrictive covennts, easements or set back lines that may be applicable; any statutory rights of redemption or any governmental agency, State or Federal; any prior liens or encumbrances as well as any priority created by a fixture filing; and to any matter that an accurate survey of the premises might disclose.

In addition, there are no known others, Individually, Corporations, Limited Liability Companies, U.S. or State Businesses that have a government, interest or prior right to the lien/Deed of Trust as aforementioned recorded in the Register’s Office, Overton County, Tennessee.

All interested parties who are interested in purchasing should have a title opinion completed if said purchasers so desire.

However, if there are same on record, said Real Property is being sold subject thereto.

Pursuant to TCA 35-5-101(e), a copy of the above Notice, as required, in TCA 35- 5-104, was served upon the above referenced debtor and Interested Parties, by lodging same with the U.S. Mail, Certified Mail, Return Receipt Requested, postage prepaid, for delivery to the addresses indicated on or before March 5th, 2020, more than thirty (30) days prior to the first publication date, pursuant to the statutory requirements.

Date of Publication, TA 35-5-101(a)(b); the Livingston Enterprise, a newspaper published in Overton County, Tennessee, the county where the land is located and the sale is to be made, which shall be published in the newspaper on the following dates: April 7th, 2020, April 14th, 2020 and April 21st, 2020.

Said sale shall be made for cash bar of all right and equity of redemption, homestead, dower, and all other rights of exemptions of every kind, all of which are expressly waived in said Deed of Trust.

Trustee is not aware of any lien claimed by the United States with respect to which the provisions of U.S.C. § 7425(b) require notice to be given to the United States. Trustee is not aware of any lien or claim of lien by the State of Tennessee with respect to which the provisions of § 67-1-1433(b) of the Tennessee Code Annotated require notice to be given to the State of Tennessee.

This sale shall further be subject to any announcements made at the time of sale,

The Trustee reserves the right to postpone or set over the date of sale in the event the Trustee deems it best for any reason at the time of sale to postpone or continue this sale from time to time, with such notice of postponement as deemed reasonable by Trustee. In the event the highest bidder at such sale fails to complete his purchase of the subject real property within the applicable time allowed, the undersigned Trustee reserves the right to complete the sale of the subject real property, without further notice of advertisement, to the next highest bidder who is able to consummate his purchase of the property within the time permitted by the Trustee. The proceeds derived from the sale of property will be applied as provided for in said Deed of Trust and are made a part hereof as if set forth verbatim herein.

At the conclusion of the sale, I, J. Steve Daniels, Trustee, will make, execute and deliver a Trustee’s Deed to the purchaser at the sale of the above described land, as Trustee, in as full and ample manner as the Trustee can convey the same.
