Whereas, Default has occurred in the performance of the covenants, terms and conditions of a Deed of Trust Note dated March 6th, 2017 and the Deed of Trust of even date securing same, Instrument #50410 recorded in Record Book 173, Page 943-946, Register of Deeds Office, Overton County, Tennessee, executed by Jeffrey W. Brown, conveying certain Real Property therein described to Steve Daniels, TRUSTEE for Jerry W. Brown and Tammy L (Beal) Brown.
Now, therefore, Notice is hereby given that the entire indebtedness has been declared due and payable and that Steve Daniels, as TRUSTEE by virtue of the power, duty and authority vested in and imposed upon said Trustee will on May 31st, 2019 on or about 10:00 a.m. at East Door of the Overton County Courthouse, Livingston, Tennessee, offer for sale certain Real Property hereinafter described to the highest bidder for and from certified funds paid at the conclusion of the sale or credit bid from a bank or other lending entity pre-approved by the TRUSTEE.

East 711.79 feet to the North west corner and being in the centerline of Peach Stone Road; thence with the centerline of Peach Stone Road, South 38 deg. 47 min. 54 sec. East 32.99 feet to a point; thence South 38 deg. 47 min. 54 sec. East 75.72 feet; thence South 61 deg. 54 min. 03 sec. East 108.71 feet to the point of beginning and containing 6.24 acres, more or less.
The above described Northern boundary line is the centerline of PEACH STONE ROAD. The Grantor reserves a permanent easement being twenty-five (25’) feet from the centerline and running parallel to the centerline of the Road for the purpose of a route of ingress and egress (public or private roads) as well as rights for underground utilities parallel to the centerline of Peach Stone Road. The reserved easement is for purposes of ingress and egress to all tracts of the development known as “THE LEDGES AT PEACH STONE CAMP”.
The grantor reserves a permanent utility easement of ten (10) feet running parallel to the adjoining road right-of-way line of each lot or tract that is depicted on the master subdivision/development plat and as described above. The utility easement may be for use for water line, natural gas lines, overhead or underground electric or related utilities. In addition to the permanent easement and additional five (5) feet beyond the permanent utility easement is reserved as a temporary construction and maintenance easement for said utilities. The total width of permanent and temporary easements is fifteen (15) feet from the right-of-way line of the road that adjoins each lot or tract with said easements running parallel to the road right–of-way line. These described permanent and temporary easements shall attach to and run with the land. The easement shall include the right to enter on the lands of Grantee at the location of the easement for initial construction of utilities as well as maintenance and repair of the utilities by both private and public utility companies, including East Fork Utility District or its successors or contractors.
It is also subject to the DECLARATION OF PROTECTIVE COVENANTS, ROAD AND COMMON LANDS for “THE LEDGES AT PEACH STONE CAMP” which has been placed of record in the Register’s Office for Overton County, Tennessee, in Deed Book 300, Page 341.
Also known as: 14488 Peach Stone, Crawford, Tennessee 38554 said Real Estate being located in “THE LEDGES AT PEACH STONE CAMP” Parcel I.D. Number 6600.
This sale is subject to all matters shown on any applicable recorded plat; any unpaid taxes; any restrictive covenants, easements or set back lines that may be applicable; any statutory rights of redemption or any governmental agency, State or Federal; any prior liens or encumbrances as well as any priority created by a fixture filing; and to any matter than an accurate survey of the premises might disclose.
In addition, there are no known others, Individually, Corporations, Limited Liability Companies, U.S. or State or Businesses that have a government, interest or prior right to the lien/Deed of Trust as aforementioned recorded in the Register’s Office, Overton County, Tennessee.
All interested parties who are interested in purchasing should have a title opinion completed if said purchases so desire.
However, if there are same on record, said Real Property is being sold subject thereto.
