NOTICE OF TRUSTEE’S SALE

 

WHEREAS, default has occurred in the performance of the covenants, terms and/or conditions of a Deed of Trust recorded November 6, 2015 in Record Book No. 155, at Pages 45-49, in the office of the Register of Deeds for Overton County, Tennessee, executed by Reta Jo Murrell and husband, David E. Murrell, conveying certain property therein described to Gregory L. Groth as Trustee for John K. Cain and Janice B. Cain, Trustees of the J. K. Cain & J. B. Cain Living Trust; and the undersigned, Blake J. Fitzpatrick, having been appointed Successor Trustee by John K. Cain and Janice B. Cain, Trustees of the J. K. Cain & J. B. Cain Living Trust.

NOW, THEREFORE, notice is hereby given that the entire indebtedness has been declared due and payable, and that Blake J. Fitzpatrick as Successor Trustee, by virtue of the power, duty, and authority invested in and imposed upon said Successor Trustee, by John K. Cain and Janice B. Cain, Trustees of the J. K. Cain & J. B. Cain Living Trust, will on April 30, 2018 at 9:00 a.m., at the Overton County Clerk & Master’s Office, Livingston, Tennessee, offer for sale certain property hereinafter described to the highest bidder FOR certified funds paid at the conclusion of the sale, or credit bid from a bank or other lending entity pre-approved by the Successor Trustee. The sale is free from all exemptions, which are expressly waived in the Deed of Trust, said property being real estate situated in Overton County, Tennessee, and being more particularly described as follows:

Beginning at a ½” Rebar (New) set this survey, said Rebar being located in the northern right-of-way of Alpine Fire Tower Road (right-of-way width varies), being located in the eastern line of Amanda Marie Rios 2012 Irrevocable Trust (RB. 115/P.759)(Trust), and being the southwest corner of the herein described tract; thence leaving the northern right-of-way of said Alpine Fire Tower Road and with the eastern line of said Trust, N 15⁰20’48” E. 1034.33’ to a ½” Rebar (New) set this survey, said Rebar being the northwest corner of the herein described tract; thence leaving the eastern line of said Trust and severing the land of Reta Jo Murrell (RB. 137/293), S 74⁰39’11” E, 277.47’ to a ½” Rebar (New) set this survey, said Rebar being located in the western right-of-way of said Alpine Fire Tower Road, and being the northeast corner of the herein described tract; thence leaving the newly created severance line and with the western right-of-way of said Alpine Fire Tower Road for the following eleven (11) calls: (1) S 27⁰42’45” W, 71.66’ to a point; (2) S 32⁰14’29” W, 97.37 to a point, said point being the beginning of a curve to the left, having a radius of 602.35’, having an acr length of 135.06’, and having a chord bearing and distance of S 25⁰49’05” W, 134.78; (3) Along the arc of the above described curve, 135.06’ to a point; (4) S 19⁰23’40” W, 148.51’ to a point; (5) S 17⁰14’49” W, 150.41’ to a point, said point being the beginning curve to the left, having a radius of 418.70’, having an arc length of 84.79’, and having a chord bearing and distance of, S 11⁰26’44W W, 84.64’; (6) Along the arc of the above described curve, 84.79’ to a point; (7) S 05⁰38’39” W, 51.14’ to a point being the beginning of a curve to the right, having a radius of 475.99’, having an arc length of 241.70’, and having a chord bearing and distance of S 20⁰11’27” W, 239.11’ (8) Along the arc of the above described curve, 241.70’ to a point; (9) S 34⁰44’15” W, 20.48’ to a point, said point being the beginning of a curve to the right, having a radius of 63.66’, having an arc length of 75.75’, and having a chord bearing and distance of S 68⁰49’31” W 71.36’; (10) Along the arc of the above described curve, 75.75’ to a point, said point being the southeast corner of the herein described tract; and (11) N 77⁰05’13” W 124.02’ to the point of beginning, containing 5.01 Acres by Survey. Being a portion of the previous and last conveyance which was a Warranty Deed from American Bank & Trust of the Cumberlands to Reta Jo Murrell filed of record in Record Book 137, Page 293, Register’s Office of Overton County, Tennessee.

The property is identified as a portion of Map 037 Parcel 033.07, Linder Mountain Road.

This sale is subject to all matters shown on any applicable recorded plat; any unpaid taxes; any restrictive covenants, easements, or setback lines that may be applicable; any statutory rights of redemption of any governmental agency, state or federal; any prior liens or encumbrances as well as any priority created by a fixture filing; and to any matter that an accurate survey of the premises might disclose. Notice is hereby given that on the 10th day of April, 2018, Letters Testimentary, in respect to the estate of Marian Hull, deceased, who died January 11, 2018, were issued to the undersigned RANDEL LEE HULL by the Chancery Court/Probate Division of Overton County, Tennessee.

All persons, resident and non-resident, having claims, matured or not, against the estate are required to file same with the Clerk and Master of the above named Court on or before the earlier of the dates prescribed in (1) or (2), otherwise their claims will be forever barred:
