NOTICE OF SUBSTITUTE TRUSTEE’S SALE
TENNESSEE, CLAY COUNTY

 DEFAULT having been made in the terms, conditions and payments provided in certain Deed of Trust executed by Joshua Justice and Kristina Justice to William Wertman, Trustee, dated July 23, 2007 in the amount of $68,458.00, and recorded in the Register’s Office of Clay County, Tennessee in Deed Book TD108, Pages 494-503, (“Deed of Trust”); and, the beneficial interest of said Deed of Trust having been last transferred to JPMorgan Chase Bank, National Association by assignment; and, JPMorgan Chase Bank, National Association, as the current holder of said Deed of Trust (the “Holder”), has appointed as Substitute Trustee the undersigned,  any of whom may act, by instrument filed for record in the Register’s Office of Clay County, Tennessee with all the rights, powers and privileges of the original Trustee named in said Deed of Trust; therefore,

NOTICE is hereby given that the entire amount of said indebtedness has been declared due and payable as provided in said Deed of Trust by the Holder, and the undersigned as Substitute Trustee, or a duly appointed attorney or agents by virtue of the power and authority vested by the Appointment of Substitute Trustee, will on Thursday, March 27, 2014 commencing at 12 P.M. at the main entrance of the Clay County Courthouse, Celina, Tennessee; sell to the highest bidder for cash, immediately at the close of sale, the following property to-wit: Map Code #050-040.01. This is Tract No. 1 of the Billy H. Bean and Sharon K. Bean Property. Being located in the 2nd Civil District of Clay County, Tennessee, on the East side of Trace Creek Road, and being the same property of record in Deed Book 24, Page 154, Register’s Office, Clay County, Tennessee. See Tax Map 50, Parcel 40.01, Tax Assessor’s Office, Clay County, Tennessee, and more particularly described as follows: Beginning at an iron rod in the East margin of Trace Creek Road, same being the Northwest corner of this tract and the Southwest corner of Michael T. Bean; thence leaving road with line of Michael T. Bean South 80 degrees 21 minutes 00 seconds East 642.75 feet to an iron rod at a 26-inch oak tree: thence with the line of Stacey Browning et al South 16 degrees 29 minutes 43 seconds West 90.75 feet to an iron rod; thence with line of Marie Bean Davis and Billy H. Bean South 82 degrees 41 minutes 36 seconds West 630.99 feet to an iron rod in the East margin of Trace Creek Road; thence with said margin along a curve proceeding clockwise, having a deflection angle of 18 degrees 35 minutes 31 seconds, a radius of 461.50 feet, a tangent length of 75.54 feet, and a chord of North 00 degrees 32 minutes 33 seconds West 149.10 feet; thence along said curve an arc length of 149.75 feet; thence North 08 degrees 45 minutes 13 seconds East 127.40 feet to the point of beginning containing 2.67 acres more or less by survey by Carroll Dean Carman, Registered Land Surveyor, Tennessee Number 910, address 150 Middle Ford Road, Hartsville, Tennessee 37074, dated November 18th, 2002. Description taken from previous deed. Being the same property conveyed to the grantor(s) herein by deed being simultaneously recorded herewith in Book 89, Pages 468-469, Register’s Office for Clay County, Tennessee. Being the same property conveyed to Josephine Jones a married person and Kenneth Gentry a married person by deed from Sharon Kay Strong dated March 31, 2006 and filed for record on April 10, 2006 in Book WD86, page 275, Clay County Clerk’s Office, Tennessee. All right and equity of redemption, statutory or otherwise, homestead and dower are expressly waived in said Deed of Trust, and the title is believed to be good, however, the undersigned will sell and convey only as Substitute Trustee. The sale will be held subject to any unpaid taxes, assessments, rights-of-way, easements, protective covenants or restrictions, liens and other superior matters of record which may affect said property; as well as any prior liens or encumbrances as well as priority created by a fixture filing; and/or any matter that an accurate survey of the premises might disclose. If the U.S. Department of Treasury/IRS, the State of Tennessee Department of Revenue or the State of Tennessee Department of Labor and Workforce Development are listed as Interested Parties in the advertisement, then the Notice of this foreclosure is being given to them and the sale will be subject to the applicable governmental entities` right to redeem the property, as required by 26 U.S.C § 7425 and T.C.A. § 67-1-1433. The sale will be conducted subject (1) to confirmation that the sale is not prohibited under the U.S. Bankruptcy Code and (2) to final confirmation and audit of the status of the loan with the holder of the Deed of Trust. NOTICE OF TRUSTEE’S SALE

WHEREAS, default has occurred in the performance of the covenants, terms and conditions of a Deed of Trust Note dated November 26, 2001, and the Deed of Trust of even date securing the same, recorded December 7, 2001, at Book TD79, Page 187 in Office of the Register of Deeds for Clay County, Tennessee, executed by Barry Harvey and Jennifer Looper Harvey, conveying certain property therein described to Atlantic Assurance Company as Trustee for Centex Home Equity Company, LLC; and the undersigned, Wilson & Associates, P.L.L.C., having been appointed Successor Trustee.
